Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Client") and Curb & Copy ("we," "us" or "our"), concerning your access to and use of the curbandcopy.com website and the purchase of our digital marketing services.

By accessing this site or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

Service Description & Professional Status

Curb & Copy provides digital post-production, Living Photos animation, and narrative-driven property website design. We do not provide primary photography services. We are a digital marketing studio and do not act as a licensed real estate brokerage, nor do we represent buyers or sellers in any capacity.

Intellectual Property & Proprietary Methods

Unless otherwise indicated, this site and its listing layout, narrative flow, and organizational structure are our proprietary property and business methods.

Our Ownership We retain full copyright and intellectual property rights in all digital enhancements, motion layers, and animation effects (the "Living Photos" assets) created by us.
Client License Upon full payment, we grant you a non-exclusive, non-transferable license to use the final edited assets for the sole purpose of marketing the specific property for which they were created.
Restrictions This license is limited to the duration of the active listing. You may not sell, lease, or transfer these edited assets to third-party vendors or other agents.

Derivative Works & Source Material

Because our services involve editing imagery provided by the Client:

Client Warranty You represent and warrant that you own or possess the necessary licenses and permissions for all photographs and media provided to us for editing.
Indemnification You agree to defend, indemnify, and hold Curb & Copy harmless from and against any claims, damages, or legal fees arising from third-party copyright infringement claims related to the source material you provide.

Client Representations

By using our services, you represent that:

  • You are a licensed real estate professional or authorized brokerage representative.
  • You have a valid listing agreement with the property owner to market the subject property.
  • All property data provided (price, square footage, features) is accurate to the best of your knowledge. You are the source of truth for all property facts.

Payment, Revisions & Fulfillment

Payment Full payment is required before production begins. Production timelines are calculated from the date payment clears, not the date of form submission. All sales are final.
Revision Policy Each project includes one (1) consolidated round of minor revisions. A revision is a correction or minor adjustment — such as updating contact information, correcting a spelling error, swapping one photo, or adjusting a text element. A revision is not a redesign. Requests that change the layout, color scheme, fonts, or require rebuilding any asset are considered a new project and quoted separately. Additional revision rounds are billed at $45 per round. Curb & Copy reserves the right to determine whether a request falls within the scope of a revision.
Quality Disclaimer The quality of our final deliverables is dependent on the quality of the source material provided. We are not responsible for defects resulting from low-resolution or poor-quality original files.
AI Disclosure Curb & Copy utilizes AI-assisted tools in the production of marketing materials, including copywriting assistance, motion generation, and image enhancement. All deliverables are reviewed and approved by a human designer before delivery.

Limitation of Liability

To the fullest extent permitted by law, Curb & Copy shall not be liable for any indirect, consequential, or punitive damages, including lost sales or data corruption. Our total liability for any claim arising out of these terms shall not exceed the amount paid by the Client to Curb & Copy for the specific project in question. Use of our services is at your own risk.

Prohibited Activities

You may not access or use the site for any purpose other than that for which we make it available. Prohibited activities include:

  • Systematic retrieval of data or content to create a collection or database.
  • Circumventing or disabling security-related features of the site.
  • Using our digital assets to create misleading or fraudulent real estate advertisements.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida. You agree that any legal action shall be brought exclusively in the courts of Pasco County, Florida.
